Zillow Media Experts New Construction Terms

Along with the Zillow Media Services Product Terms (the “Zillow Media Experts Terms”), these Zillow Media Experts Services New Construction Terms govern your use of the Media Services (together, with the Zillow Media Experts Terms, the “NewCon Terms”).  Capitalized terms used but not defined herein shall have the meaning set forth in the Zillow Media Experts Terms, as applicable.

For purposes of these NewCon Terms, “Builder” means the owner of a new construction home and “Model” means a model developed by a Builder as identified in the Zillow Media Experts Order.

Zillow License Grant: Your License to the Media Services. Subject to the terms and conditions of these NewCon Terms, We grant Builder a limited, sub-licensable license to use the Media Services for the sole purpose of: (1) marketing the Model on a listing within the United States; (2) submitting the Model in a listing to a Multiple Listing Service (MLS) to be published in and used in connection with the MLS or Service Compilation (as defined by each MLS) over which the MLS claims copyright; (3) creating derivative works if you are a participant in a MLS and have received a copy of any Zillow Media Experts photographs in the MLS or Service Compilation provided by your MLS (you may sub-license or sell your derivatives, but you may not sub-license or sell the Zillow Media Experts photographs themselves to a third party); (4) including in comparables to assist with pricing homes and creating comparative market analyses (CMAs); and (5) including in marketing materials for your professional real estate or photography services.  For the purposes of clarity, if you associate or add a link to a Tour (including links to virtual tours with IMX interactive floor plans) for a Model on more than one listing, the standalone image viewing tab and photo localization feature are not available.  Tours on Zillow.com are not impacted by the limitations described in the prior sentence.  

Except as amended herein, the Zillow Media Experts Terms shall remain in full force and effect.  In the event of any conflict between the Zillow Media Experts Terms and these NewCon Terms as it relates to the Zillow License Grant, these NewCon Terms shall govern.
